1. Introduction
Welcome to WildHire, a platform connecting businesses with hospitality and tourism professionals. By using our services, you agree to these Terms & Conditions.
2. Definitions
"WildHire" refers to our platform and services.
"User" refers to businesses and hospitality and tourism professionals using WildHire.
"Professional" refers to individuals seeking employment or work opportunities in the hospitality and tourism industry, including but not limited to guides, lodge staff, and other tourism-sector roles.
"Business" refers to any entity operating in the hospitality and tourism industry seeking to engage or employ Professionals, including but not limited to lodges, hotels, tour operators, and other tourism-sector businesses.
3. WildHire's Role
WildHire provides a platform for businesses to find hospitality and tourism professionals, and offers paid access to its professional database and related search features (see Section 9). We do not employ, contract, or manage Professionals, nor are we involved in any payments between businesses and Professionals. Once a business connects with a Professional, all further arrangements, including payment and work agreements, are their responsibility. WildHire does not guarantee that any application will result in a response, interview, or offer from a business.
4. User Responsibilities
Businesses must conduct their own due diligence before engaging a Professional.
Professionals must ensure they are legally eligible to work in the applicable region.
Users must communicate honestly and professionally.
Professionals must submit applications in good faith, for roles they are genuinely interested in and reasonably suited to. Mass, repetitive, indiscriminate, or automated applications ("spam applications") are prohibited, as applications are delivered directly to businesses' live inboxes and place a burden on their operations.
5. Vetting Process
WildHire conducts limited vetting of Professionals which includes reference checks. This process does not guarantee a Professional's skill, professionalism, or reliability. References must be less than 6 years old to be included on your profile. We will attempt to contact each reference for verification; if no response is received, the reference will not be added.
6. No Guarantees & Liability Disclaimer
WildHire does not guarantee the quality, reliability, or conduct of Professionals.
WildHire does not guarantee or control whether businesses respond to applications, and is not liable for a lack of response, delayed response, or any outcome arising from non-response.
WildHire is not liable for any disputes, damages, or losses resulting from engagements facilitated through our platform.
Users engage at their own risk and should take independent precautions.
7. Intellectual Property
All content on WildHire, including logos, text, and branding, is the property of WildHire. Users may not use or distribute our content without permission.
8. Privacy & Data Use
WildHire collects and processes user data as outlined in our Privacy Policy. By using our platform, you consent to this data collection. In accordance with the Protection of Personal Information Act (POPIA), users may request access to, correction of, or deletion of their personal data by contacting us as set out in our Privacy Policy.
9. Payments & Refunds
WildHire offers paid access to its professional database and related search features. All sales are final. WildHire does not offer refunds once access has been granted or a purchase has been processed, except as required by the Consumer Protection Act or other applicable law.
10. Account Suspension & Termination
WildHire reserves the right to suspend or remove an account, temporarily or permanently, at its sole discretion, including but not limited to instances of spam or repetitive applications, abusive conduct towards WildHire staff, or other violations of these Terms & Conditions or misuse of the platform.
Where reasonably practicable, WildHire will notify the user of the reason for suspension and any steps needed to restore access. Continued or repeat violations following a suspension may result in permanent removal from the platform without further notice.
11. Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of South Africa. Disputes must first be addressed through direct negotiation, and if unresolved, through arbitration or legal channels.
12. Updates to These Terms
WildHire may update these Terms & Conditions at any time. Continued use of the platform signifies acceptance of any changes.
By using WildHire, you acknowledge and agree to these Terms & Conditions.
